Judgment & Decree
EDUCATION DEPARTMENT Appeal No. 340/101 of 1977, decided on 30th December, 1979. ‑ S. 4‑Claim of Teacher of nationalised school for S. E. T. grade ‑from certain date prior to nationalisation‑Service nationalised as J. V. Teacher with additional charge as P. T. C. ‑No case, held, made out to support claim‑Appeal dismissed. M. SALEEM CHAUDHRY (CHAIRMAN).‑--Briefly the facts of the case are that the appellant joined the Model Girls High School, Model Town, Lahore, on 18th September, 1950 in the B. T. Grade. The appellant was then transferred by the Model Town Co‑operative Society to the Junior Model School, Model Town. The Government vide M. L. R. No. 118 took over the control of the aforesaid School on 1st October, 1972 and from that date the appellant was drawing the
13. T. Grade. The appellant continued to enjoy this scale till July 1974 when she was given a junior pay scale of P. T. C. She was awarded SET scale with effect from December, 1975.
2. Both the parties have been heard. The appellant has prayed that the respondent be ordered to treat her previous service from 18th Septem ber, 1950 instead of 10th December, 1975 in the SET scale as it is against facts and law and is in violation of M. L. R. The Government's contention is that according to the record the service of the appellant was addition nationalized as J. V. Teacher and she also worked as P. T. C. in addition. The appellant has not been able to make out a case and the appeal is, therefore, dismissed. Appeal dismissed.
