XIII, r. 1-Petition for Special Leave to Appeal-Delay of each day in filing, to be explained-Petition barred by 5 days-Dismissed-Constitution of Pakistan (1962) Art. 58(3).
Judgment & Decree
FALZE-ALBAR, J.-This petition is barred by time by 5 days. Judgment in the Second Appeal was delivered on 6-3-67 and application for a certificate under clause 10 of the Letters Patent was rejected on 1-5-67, This petition for special leave was filed on 3-6-67. In the petition for condonation of the delay, it is stated that the petitioner was entitled to get benefit of 36 days that he spent in pursuing his petition under clause 10 of the Letters Patent, No doubt, he is entitled to get extension of time till 1-5-67 when his petition for a certificate was refused, but then he has to explain the delay of each day after the said date. This, he has not done. We accordingly dismiss this petition as time-barred. Petition dismissed.
