(From the judgment of the Lahore High Court, dated 29‑3‑1987 in Intra Court Appeal No.167 of 1985). ‑‑‑S.3(1)(b)‑‑Constitution of Pakistan (1973), Art.185(3)‑‑Leave to appeal granted to examine contention that neither the possession of the petitioner could be disturbed nor petitioner be denied the right accrued to him under S.3(1)(b) of the Act of 1975 under which provision he had a statutory right to retain the property in dispute.
Judgment & Decree
GHULAM MUJADDID, J.‑‑Contends, inter alia, that neither the possession of the .petitioner could be disturbed nor the petitioner be denied the right accrued to him under section 3, subsection (1), clause (b) of Act XIV of 1975 under which provision he had a statutory right to retain the property in dispute. The point needs examination. Leave is accordingly granted. Security Rs.5,
