1989. (On appeal from the judgment dated 23‑1‑1988 of the Peshawar High Court, in Civil Revision No. 670 of 1986). ‑‑‑O. IX, Rr. 6 & 13‑‑Constitution of Pakistan (1973), Art. 185 (3)‑‑Ex parte decree, setting aside of‑‑Petitioner was unable to meet the rule laid down in the case of Rehman Weaving Factory (Regd.), Bahawalpur v. Industrial Development Bank of Pakistan PLD 1981 SC 21, which was against him‑‑Petition dismissed. Dale of hearing: 13th May, 1989.
Judgment & Decree
MUHAMMAD AFZAL ZULLAH, J.‑‑Setting aside of an ex parte decree at the instance of the respondents/defendants side has been called in question through this petition for leave to appeal. After some arguments learned counsel for the petitioners was unable to meet the rule laid down by this Court in Messrs Rehman Weaving Factory (Regd.) Bahawalnagar v. Industrial Development Bank of Pakistan (PLD 1981 Supreme Court 21) which goes against them. This petition accordingly is dismissed as without any force. M.A.K./R‑95/S Petition dismissed.
