Judgment & Decree
Asif Jan and Ch. Mushtaq Masood for Petitioner. Altaf Muhammad Khan for Respondents. Date of hearing: 14th May, 1988. The petitioner, Bashir Ahmad, has moved this Constitutional petition praying therein that respondent No. 1, Secretary to Government of the Punjab, Irrigation and Power Department, Lahore, may be directed to consider the petitioner to be eligible for the purposes of promotion to the rank of Sub- Divisional Officer (BPS-17) on the basis of the relaxation/exemption made by the competent authority.
2. In compliance with the order of the Court, respondent No. 1 has sent written comments in the case, which have been placed on record.
3. Learned counsel for the parties are present and have been heard. Mr. Asghar Ali, Assistant I & P Department, is present on behalf of respondent No.
1. He has made a statement in Court that he has filed the written statement in the case and that he has read the prayer part of the writ petition. He stated that the question pertaining to the eligibility for the purposes of promotion of the petitioner shall be considered by respondent No. 1 in accordance with law. Learned counsel for the petitioner is satisfied with the statement of the representative of respondent No.
1. Accordingly, on the basis of the statement of Mr. Asghar Ali, Assistant I & P Department, the respondent No. 1 shall hear the petitioner about the question pertaining to his eligibility for the purposes of promotion to the rank of S.D.O. (BPS-17) and shall decide the same in accordance with law. With this observation, this petition stands disposed of as having borne fruit. AA./B-91/L Order accordingly.
