Art.199--Punjab Local Government Ordinance (VI of 1979), Ss.52, 60 & 80--Performance of compulsory functions under Ss.52 & 60- Petitioner filing constitutional petition for directions to Municipal Corporation to perform its compulsory functions under Ss.52, 60 & 80 in respect of specified street-Respondent Corporation having given assurance to Court to construct the road without loss of time, petition was disposed of as having borne fruit. Petitioner in person. The petitioner Mr. M. Farani, Barrister-at-Law has moved this Constitutional petition praying therein that the respondent Lahore Municipal Corporation, Lahore, be directed to perform its compulsory functions under sections 52, 60 and 80 of the Punjab Local Government Ordinance (VI of 1979) with regard to street No.36-S, Bank Street, Bastami Road, Samanabad, Lahore. Respondent No.1 was directed to submit a report with parawise comments and a direction was issued to the learned Legal Advisor of the respondent to appear before this Court today. In compliance with the order learned counsel for the respondent as well as the representative of the respondent have appeared before me. The Sub-Engineer of the Lahore Municipal Corporation, Lahore, has made a categorical statement saying that they will construct the road within a period of one month. He has further stated that, they will level the road with the roller immediately so as to enable the petitioner to use the same. Statement of Zahoor Ahmad, Sub-Engineer, Zone No.3 Lahore Municipal Corporation, Lahore, on S.A. I am Sub-Engineer of the Lahore Municipal Corporation, Lahore. I hereby give assurance that the Corporation will, within a period of one month, complete the construction of the road known as Bank Street Bastami Road, Samanabad, Lahore. The Corporation will start the construction work without losing any time. The street will be levelled by using the roller immediately.
2. In view of the statement having been made by the representative of the respondent Corporation, this petition is accordingly disposed of as having borne fruit. H.B.T./M-403/L Order accordingly.
