Ghulam Qadir v. Member Board of Revenue 1970 S C M R 292 and Muhammad Hussain v. Sikandar P L D 1974 S C 139 ref.

Judgment & Decree

SAAD SAOOD JAN, J.--The only contention raised in support of this petition relates to the question as to which of the parties had a better claim of the land falling in squares No.38 and 39 during the course of the consolidation proceedings. This question has been considered by the Board of Revenue in pursuance of an order of remand by the High Court in writ petition No.3301 of 1980 and it has recorded a finding adverse to the petitioners. The High Court has declined to interfere with this finding in the second constitutional petition. It may be noticed that the view taken by the High Court finds support from a number of decisions of this Court, two of which have been reported as Ghulam Qadir v. Member Board of Revenue 1970 S C M R 292 and Muhammad Hussain v. Sikandar P L D 1974 SC

139. This petition is without any merit and is hereby dismissed. M.I./A-137/S Petition dismissed.
