Appointment against vacancy caused by migra tion of non‑Muslim Lambardar‑Temporary Lambardar may be appointed permanent Lambardar if he is otherwise qualified‑Solitary dereliction of duty as temporary Lambardar is no disqualification for appointment as permanent Lambardar. This is a revision petition against an order of the Commis sioner, Multan Division, dated 8‑4‑57, upholding the order of the Collector, Lyallpur, dated 24‑5‑56, whereby the respondent was appointed a Lambardar of Patti Pritam Singh of Chak No. 154‑G. B. Tehsil Toba Tek Singh, District Lyallpur. The vacancy had occurred owing to the migration of the non‑Muslim Lambardar to India. I have heard Mr. M. S. Anwar, Advocate, for the petitioner. The petitioner is a Jat while the respondent is an Arain, which is the predominant tribe in the Patti. Both the candidates were previously Lambardars in East Punjab. It has again been contended before me that while acting as temporary Lambardar the respondent was convicted for his failure to report a theft in the village and fined a sum of Rs.

The respondent's work otherwise is reported to be satisfactory and I agree with the Collector and the Commissioner that this solitary dereliction o duty would not warrant passing over the claims of the respondent for this post. His holding is admittedly also inadequate but the Collector has already taken steps to obtain a sufficient security from him for the payment of Government demand. I do not see sufficient grounds for interference with the con current choice of the Collector and the Commissioner and dismiss the petition in limine. K. M. A. Petition dismissed.
