Recording of the version of the petitioner
Petitioner was complainant in the case already registered under S. 302/34, P.P.C.
Respondent/Investigating Officer had refused to record the version of the petitioner who according to the counsel was duty bound to record the same and investigate in the matter
Without going into the correctness or incorrectness of the contentions raised in the petition Investigating Officer was directed to record the version of the petitioner and investigate the case in an independent and impartial manner after affording equal opportunities to all the concerned persons including the private respondents and conclude the investigation in accordance with law
Constitutional petition was allowed accordingly.
Judgment & Decree
IJAZ AHMED CHAUDHRY, J.
The petitioner is a complainant in case F.I.R. No. 443 of 2001 registered on 4-12-2002 under section 302/34, P.P.C. at Police Station Mumtaz Abad District Multan. Respondent No.4 is the Investigating Officer and has refused to record the version of the petitioner. According to the learned counsel for the petitioner, respondent No.4 is duty bound to record the version of the petitioner and investigate the same.
2. Without going into the correctness or incorrectness of the contentions raised in this petition, respondent No.4 is hereby directed to record the version of the petitioner and shall investigate the case in an independent and impartial manner after affording equal opportunities to all the concerned persons including respondents Nos. 6 to 9 and shall conclude the investigation in accordance with law in an impartial manner.
3. With this direction this petition stands disposed of. N.H.Q./M-533/L Petition allowed.
