Civil Procedure Code (V of 1908)‑‑‑ ‑‑S. 24‑‑‑Transfer of case‑‑‑Petitioner's ground for transfer of case from the Trial Court was that Chairman Municipal Committee being personally interested the case there was likelihood that he might influence the Trial Court‑‑‑ Allegation that the Chairman, Municipal Committee was seen at the house of the Presiding Officer of the Court did not appeal to reason because why the petitioner had gone there on the arrival of Chairman‑‑‑Petitioner's allegation geared to be figment of his imagination‑‑‑Transfer application was dismissed being without merit.

Shahid Mahmood, respondent No.2 has been personally served, but he has not appeared. He may be proceeded against ex parte.

This transfer application has been moved by the petitioner for the transfer of his case pending in the Court of learned Civil Judge 1st Class, Chishtian, on the ground that the Chairman, Municipal Committee Chishtian, is personally interested in this case and there is likelihood that he may influence the learned Civil Judge in this matter.
3. It is very difficult for a person like the Chairman to approach the learned Civil Judge even on a personal matter. The allegation that the Chairman, Municipal Committee, was seen at the house of the learned Civil Judge does not A appeal to reason because why the petitioner had gone there on the arrival of the Chairman. It appears to be figment of his imagination. I see no merit in this transfer petition and dismiss the same. AA./R‑217/L Application dismissed.
