Judgment & Decree
Lambardar--New post‑Absentee's appointment set aside and suitable resident directed to be selected. The Collector, Sargodha, vide his order dated 9‑8‑1960, appointed Ahmed Khan, respondent as Lambardar of Chak No. 4‑N-B., in a vacancy caused by the dismissal of Muzaffar Khan Lambardar who had disposed of his entire holding in the estate. The petitioner Wajid Ali was overlooked by the Collector for the reason that he owns a small area and had also been bound down to keep the peace for one year. In appeal the learned Additional Commissioner maintained the appointment of Ahmad Khan. Wajid Ali has come up in revision. The main point argued on behalf of the petitioner is that he was ignored by the officers below as he was bound down to keep the peace whereas the respondent, who also had been bound down in another case had been appointed Lambardar. This position was denied by the respondent and a report from the Collector Sargodha bears him out. The allegation is due to a confusion of names and it is another Ahmad son of Lala son of Zaida who had been bound down and not the respondent. Another important question to be considered in this case is that both the claimants do not reside in the village. As this is a new Lambardari I am not in favour of appointing a person who is an absentee. The Collector has not stated that a suitable resident is not forthcoming. I would interfere on this ground, set aside the appointment and direct the Collector to select a suitable resident for this post. A. H. Order accordingly.
