Judgment & Decree

RIAZ AHMAD, J.‑‑ The petitioner has been arrested in the case registered against him and others under section 409, P.P.C. at Police Station. Kotwali, District Sialkot.

2. The allegation levelled in the F.I.R. is that the petitioner had misappropriated/embezzled a sum of Rs.52,000 from the account of Mst. Niamat Bibi, in the Kotli Loharan Post Office Branch. Mst. Niamat Bibi after the registration of case made statement before a Magistrate on 29‑11‑1988 (a copy of which has been produced by learned counsel for the petitioner during arguments) that the amount deposited by her in the Post Office Branch, has been received by her. At the best, it can be said for the State that Mst. Niamat Bibi has compromised. Be that as it may, the fact remains that she is not insisting on the allegation levelled against the petitioner. In the circumstances, a case for further enquiry, therefore, appears to have been made out. This petition is, therefore, allowed. The petitioner shall be released on bail, provided he furnishes bail bond in the sum of Rs.1,10,000 (Rs. one lac ten thousand only) with two sureties each in the like amount to the satisfaction of the Assistant Commissioner, Sialkot. S.A./A‑697/L Bail allowed.
