Judgment & Decree

‑‑‑S. 497‑‑Offence of Zina (Enforcement of Hudood) Ordinance (VII of 1979), Ss. 10 & 11‑‑Bail, grant of‑‑Petitioner, allegedly disappeared with her paramour sui juris and having a suckling baby‑‑Provisions of Art. 11, Offence of Zina (Enforcement of Hudood) Ordinance, held, not attracted, in circumstances‑‑Petitioner allowed bail. Zarina petitioner has moved this. petition for bail in case under Articles 10 and 11 of the Offence of Zina (Enforcement of Hudood) Ordinance, 1979.

2. The F.I.R. was lodged by Khuda Bakhsh, the father of the petitioner, on 28‑7‑1986 wherein he alleged that co‑accused Muhammad Siddique son of Imam Din developed illicit relation with Mst. Zarina. On 28‑7‑1986 she disappeared leaving her 11 years old daughter at his house; he started searching her when he was informed by Yousaf and Muhammad Hanif that they had seen Mst. Zarina boarding alongwith aforesaid Muhammad Siddique son of Imam Din and his nephew Muhammad Latif.

3. Learned counsel for the petitioner contends and the' learned State counsel concedes that Article 11 of Ordinance VII of 1979 is not attracted in the case of the petitioner. The petitioner is a woman having a suckling baby who is presently with her maternal‑grandfather. In the circumstances I admit her to bail in the sum of Rs.5,000 with one surety in the like amount to the satisfaction of A.C. Lahore Cantt. The surety should be either the husband of the petitioner or any other person related to her within the prohibited degree. S. G. D. /Z‑25‑/L Bail allowed.
