Judgment & Decree
Appellate Side No. 87/12 of 1960‑61, decided on 28th February 1961, District Gujranwala. Lambardar‑Appointment‑Absentee not appointed. Petitioner in person. ` Ghazanfar Ali for Respondent. The Collector, Gujranwala district by a somewhat laconic order appointed the appellant Lambardar of Kot‑ Ladha in his district. The learned Additional Commissioner intervened on appeal on two grounds firstly that the appellant is almost the sole representative of his tribe in this estate; and secondly that he is an absentee, being the resident of a neighboring village. The appellant is comparatively a big landlord who has been allotted land in several villages in the Province. He has, therefore, good reasons to be absent from Kot Ladha in order to look after his extensive property. I am disinclined to accept the appeal merely because he is a big landlord and was a Lambardar preen dependence. In view of his extensive property elsewhere his usefulness as a Lambardar of this estate is not, likely to be much and it would not be in the public interest to appoint him as very soon he will either ask for a sarbrah or remain constantly absent. I would therefore decline to interfere in the order passed by the learned Additional Commissioner and dismissal this revision petition. K. M. A. Appeal dismissed
