Judgment & Decree
‑‑‑S. 514‑‑Amount of bail bond reduction in‑‑Petitioners apprehended, while travelling in truck in which 10 Kg. heroin and 25 K.G. Charas found concealed in secret cavity, built in driver's cabin‑‑Petitioners seeking reduction in bail bonds same being too heavy to be secured by them‑‑In view of gravity of offence and tendency of accused to flee out of Pakistan, interference with the order of competent Court declined. Nazir Ahmad Shami for Petitioners. Sh. Maqbool Ahmad‑II and Qamar‑uz‑Zaman for Respondent. This is a petition under section 439 Cr.P.C. by Hazrat Wali and Qadir Khan, petitioners, for the reduction of the bail bonds ordered to be furnished by the learned Special Judge Customs, Lahore, under his order dated 3‑1‑1988.
2. Arguments heard. The truck which was apprehended and in which the two petitioners were found on search was found to contain 10 Kilograms of heroin and 251 kilograms of Charas, which was recovered from a secret cavity built in the driver's cabin. In view of the heinousness of the offence, the learned Special Judge, whilst granting bail to the petitioners, directed them to post bails in the, sum of Rupees two lacs (Rs.2,00,000) each with two sureties each in the like amount to his satisfaction. The petitioners desire that the bail amounts may be reduced, as what has been ordered to be posted are heavy amounts which the petitioners will never be able to secure. In view of the gravity of the offence and the tendency on the part of such accused to flee to Afghanistan, I do not think this to be a fit case for the reduction of the bail bonds.
3. There being no merit in this petition the same is dismissed. S.G.D./H‑63/L Petition dismissed.
