Judgment & Decree
S. 439--Criminal trial--Evidence, appreciation of--Complainant in her Court statement making departure from her earlier version and also introducing Kassi as weapon of assault, alongwith Sotas--Ocular testimony of complainant's daughter also discrepant and not in line with the statement of complainant while third eye-witness of occurrence not at all supporting prosecution case and declared hostile- Interference with order of acquittal recorded by lower Courts, declined in circumstances. Petitioner in person. Hasnat Ahmed for Respondents. This revision petition calls in question the order dated 18th May, 1985 delivered by a Magistrate at Gujranwala whereby the respondents were acquitted and also the orders dated 4th December, 1986 delivered by the learned Additional Sessions Judge, Gujranwala dismissing the revision filed by the complainant assailing the acquittal of the respondents. 2. This second revision has been filed to assail the acquittal. I have perused the record in this case. 3. The prosecution case, in brief, is that on 19th June, 1981 after Juma prayers, respondents armed with Sotas forming an unlawful assembly caused injuries to Mst. Ahmed Bibi. The complainant petitioner after entering the witness-box made a departure from the earlier version narrated by her, inasmuch as, the complainant also introduced Kassi as weapon of assault by the respondents. Statement of PW-2 Mst. Rani a daughter of the complainant is discrepant and is not in line with the statement of the complainant. Third eye-witness, namely Dilber PW-4 did not at all support the prosecution case and was declared hostile in cross-examination. 4. Considering the case from all angles and after having gone through the evidence on the record, I find no force with the acquittal of the respondents. Accordingly, this petition is dismissed. S.G.D./A-197/L Petition dismissed.
