Joint petition by several accused for Special Leave to Appeal before Supreme Court concerning bail‑During pendency of petition, bail granted by inquiry Court to some of petitioners Aggrieved petitioners, in circumstances, directed to move High Court first against fresh order rejecting their bail application. Nemo for the State.
Judgment & Decree
SAJJAD AHMAD J.‑It is stated by the learned counsel for the petitioners that during the pendency of this petition, the inquiry Court which has recorded a good part of the evidence of the prosecution, has on x fresh application by the accused persons allowed bail to three of them and has refused it to the others. This has created a new situation rendering the present petition as infructuous. The aggrieved petitioners must try their remedy in the High Court against the fresh order rejecting their bail application before they make a resort to this Court. The petition is dismissed. Petition dismissed.
