Decisions of superior court binding on other courts

Principles of law laid down by the Supreme Court are not only binding on all the government departments but the government functionaries serving therein are also duty bound to follow such principles in letter and spirit, and in case of violation of the dicta laid down by the superior courts, the concerned officials shall have to be proceeded against under the law of contempt

Judgment & Decree

Mr. Sh. Riaz Ahmed, appearing for City District Government has stated at the bar that the Governing Body of the City District Government Karachi has directed for conversion of amenity plot into commer cial; he has been pointed out the decision as reported in 1999 SCMR 2883, and also that it is part of duty of a Law Officer to guide the concerned officer properly with regard to the settled principles as laid down by the Honourable Supreme Court, which are not only binding on all the Government departments, but also that the Government functionaries serving therein are duty bound to follow such principles of law in letter and spirit, and that in case of violation of the dictum laid down by the Honourable superior Courts, the concerned officials shall have to be proceeded with under the law of contempt. He seeks one week's time to submit proper reply of the Governing Body in black and white. H.B.T./M-90/K Order accordingly.
