S. 497--Penal Code (XLV of 1860), Ss. 420, 467, 468 & 471--Bail--Accused, a bank employee, charged for misappropriating pension amount, was arrested on filing of complaint by F.I.A. and admitted to bail by Sessions Judge but again arrested and since then remained in custody--Bail application of accused filed before Presiding Officer Special Court (Offences in Banks) remained undecided although more than two years had elapsed from date of filing of original complaint and investigating agency was likely to have collected some material against accused--Presiding Officer Special Court directed to decide application on merits within a month--Bail declined. Qazi Faez Isa for the State.

Judgment & Decree

AJMAL MIAN, C.J.--The applicant, who is facing trial under section 420/467/468/471, P.P.C. in Crime No. 254/86 alongwith certain other co-accused for allegedly misappropriating the pension amount of Rs.4,50,398.63 had applied for bail before the learned Presiding Officer Special Court (Offences in Banks) Karachi. Originally the applicant was arrested in 1986 after the filing of the complaint by F.I.A. but he was admitted to bail by the learned Sessions Judge, Jacobabad, in 1982. Thereafter, he was arrested again on 4-3-1989 and since then he is in custody. The learned Presiding Officer has not decided the applicant's application for bail which he had filed.

In our view, it will be appropriate to direct the learned Presiding Officer, Special Court (Offences in Banks) Karachi to decide the application on merits within a period of one month-from the date of the receipt of a copy of this order as more than 2 years have passed from the date of filing of the original complaint, the Investigation Agency must have collected some material against the applicant. With the above observation, the application is dismissed. M.Y.H./H-166/K
