Judgment & Decree

Appeal No. R.Y.Khan‑317 of 1987, decided on 5th October, 1987. ‑‑‑Ss. 25‑A & 38(3)‑‑Grievance petition, neither presented before Labour Court by petitioner himself nor petitioner appearing within limitation period after presentation‑‑Labour Court dismissing petition due to improper presentationOrder of Labour Court, held, amounted to rejection of petition‑‑Appeal being devoid of merit was dismissed in circumstances. Muhammad Suleman Malik for Appellant. Date of hearing: 5th October, 1987. This is an appeal against the decision dated 9‑9‑1987 recorded by learned Presiding Officer Punjab Labour Court No.8, Bahawalpur whereby the grievance petition of the appellant was dismissed on the ground that neither it was presented by the appellant himself nor he appeared before the Court after presentation during the period .of limitation meant for bringing the grievance petition. In the grounds of the appeal it is not urged that the grievance petition was prescribed by the appellant himself or that he was present alongwith his counsel in the Court at the time of presentation or that he had himself appeared before the Court after the date of presentation within limitation. Since admittedly the grievance petition was not presented by the appellant himself, the same cou1J A not proceed. No doubt the learned lower Court has dismissed the petition but since it was not decided on merits the order of dismissal amounts to rejection of I the petition. There is no merit in the appeal, the same, therefore, is dismissed in limine. AE/447/Lb/P. Appeal dismissed .
