Judgment & Decree
The Commissioner created two additional Lambardaris in village Malka Hans, tehsil Pakpattan, district Montgomery. The appellant alleges that he was not given any opportunity of being heard before the Commissioner passed the order creating the two Lambardaris. The Commissioner was requested to arrange for the defence of the case, but none has appeared on behalf of the State. It would thus appear that the contention of the appellant that no opportunity was given to him to place his case before the Commissioner must be accepted. In P L D 1950 (Rev.) pp. 295‑96, the order of the Commissioner was set-aside on the ground that such an opportunity was not given to the interested person. The result is that, without going into the merits of the case, the order of the Commissioner creating the additional Lambardaris is set aside with the direction that fresh order should be passed after giving the interested person an opportunity of being heard. K. M. A. Appeal accepted.
