‑‑‑S. 16‑‑Criminal Procedure Code (V of 1898), S. 497‑‑Bail‑ Eye‑witnesses swearing affidavit about innocence of accused‑‑Bail granted.‑‑[ Affidavit]. Muhammad Rafiq Khan Chauhan for Petitioner. Wafadar Khan for the State. The petitioner is stated to have stolen a tape recorder on the night between 14/15 September, 1987. He was seen committing theft by the complainant as well as Asif and Akhtar P.Ws. but they could not arrest him as he managed to escape from the spot. The petitioner was allowed pre‑arrest bail which was subsequently re‑called. The petitioner is stated to be in jail since October, 1987.

2. The petitioner's bail plea was declined by the lower Court hence this petition.

3. I have heard the learned counsel for the petitioner and the State.

4. It is stated that the two eye‑witnesses namely Asif and Akhtar have sworn affidavits about the innocence of the petitioner. In the circumstances, I feel inclined and allow this petition. The petitioner shall be released on his furnishing bail bond in the sum of Rs.10,000 with one surety in the like amount, to the satisfaction of A . C . /Duty Magistrate, Gujranwala. M.Y.H./N‑85/L Bail granted.
