Judgment & Decree
Irshad Ahmad for Petitioner. Akhtar Gillani for the State. This is an application for pre-arrest bail on behalf of Mst. Zeboo Mai in a case under section 16 of the Offence of Zina (Enforcement of Hadood) Ordinance, 1979, registered at Police Station Musafir Khana vide F.I.R. No. 74/80.
2. The facts leading upto this petition in brief are that Mst. Zeboo Mai was arrested in the aforesaid case. She was allowed bail by the Court of competent jurisdiction and on one date when she failed to appear before the learned Additional Sessions Judge, Bahawalpur, he issued non-bailable warrants for her arrest.
3. Learned counsel for the petitioner submits that since Mat. Zeboo Mai was again abducted, therefore, she could not appear before the trial Court. As against this learned counsel for the State had opposed this application on the ground that the petitioner once having been released on bail has misused the concession.
4. After hearing the learned counsel I find that as for the merits, Mst. Zeboo Mai was allowed bail by a Court of competent jurisdiction and as for absence she has given explanation supported by affidavit and assures that she will not absent herself in future.
5. For what has been stated above the interim bail already granted to her on 23-8-1983 is hereby confirmed. M.Y.H. Anticipatory bail confirmed.
