Judgment & Decree

KHALIL AHMAD, J.

Petitioner is Project Manager of Pak German Poly Technic Institute of Cooperative Agriculture, Multan. He has filed this petition alleging that the students who have passed Field Assistant two years course from their institute is equated to the Higher Secondary School Certificate by Inter Board Committee of Chairman, Government of Pakistan, Ministry of Education, Islamabad but they are not being allowed to appear in the B.A (Bachelor of Arts), examination by the Baha-ud-Din Zikriya University, Multan. Further states that course of Field Assistants have been up-graded and renamed as Diploma of Agriculture Sciences (DAS) and now the duration of this course is three years and the institution is affiliated with Agricultural University, Faisalabad and examination of this course is being conducted by the afore-mentioned university; that two years post matric diploma of Field Assistant has been declared equivalent to Higher Secondary School Certificate (Agriculture group after passing English, Urdu and Pak Studies from any Board of Intermediate and Secondary Education in Pakistan or Allama Iqbal Open University); further states that non-acceptance of diploma of Field Assistant two years course is contrary to the decision taken by the IBCC and that Baha-ud-Din Zikriya University has issued Letter No.Acad 2232 dated 13-3-2008 by which they have set condition for the acceptance or otherwise of the students in B.A. By virtue of this letter, they have foreclosed the admission of diploma-holders to B.A. Petitioner states that Field Assistant Diploma Holders has already met the condition of Passing of English, Urdu and Pakistan Studies but in spite of that respondent No.1 has disallowed admission to them contrary to the decision of IBCC.

2. Report and parawise comments were called for and have been filed by the respondents.

The IBCC in its order dated 15-3-2008 has informed the petitioner as under:- "This is to inform that as per IBCC Rules Diploma of Field Assistant awarded by University of Agriculture, Faisalabad or an Institute affiliated with it is equivalent to Higher Secondary School Certificate (Agriculture Group), subject to passing English, Urdu and Pakistan Studies at HSSC level from any Board of Intermediate and Secondary Education in Pakistan or Allama Iqbal Open University."

It is, thus, clear that the Diploma of Field Assistants awarded by the University of Agriculture, Faisalabad or any of the Institute affiliated with it is equivalent to Higher Secondary School Certificate (Agriculture Group), subject to passing English, Urdu and Pakistan Studies at HSSC level from any Board of Intermediate and Secondary Education in Pakistan or Allama Iqbal Open University.

6. Learned counsel for the petitioner is unable to point out any illegality in the impugned decision of Baha-ud-Din Zakriya, University, Multan which is in conformity with the policy framed by the IBCC. This petition being devoid of any force is dismissed. S.A.K. /Z-12/L Petition dismissed.
