MUHAMMAD MUNIR, C. J.‑‑The result of this appeal is deter mined by the decision of this Court in Mussafir v. Government of West Pakistan and another Criminal Appeal No. 54 of 1957 and since the relevant facts of both the cases are identical, for the reasons given in the judgment in Criminal Appeal No. 54 of 1957, we accept this appeal and issue an order prohibiting the Provincial Government and the Superintendent, District Jail, Gujranwala from executing the sentence of death and directing that the order of commutation of sentence into that of transportation for life passed by the Central Government be given effect to. Appeal accepted.
