Mirza, Senior Advocate Supreme Court (Zaki‑ud‑Din Pal, Advocate Supreme Court with him) instructed by Maqbool Ahmad Qadir, Attorney for Petitioner. Nemo for the State. Date of hearing : 26th October 1967. S. A. RAHMAN, J.‑The petitioner Manzoor Hussain Shah, is present with his counsel Mr. G. M. Mirza, and surrenders himself to the Court. The allegations against him were that the culprits in a case under sections 366, 448, 307 and 148, read with section 149 of the Pakistan Penal Code, had escaped after the occurrence in the taxi driven by the petitioner. It is not clear how far the taxi was from the site of occurrence, but the culprits are said to have entered it on the public road, at some distance from the spot. There is no other allegation apparently made against the petitioner in the First Information Report, a copy of which has been placed on the record. In the circum stances it is for consideration whether the High Court were right in not allowing bail to this petitioner. We therefore, grant leave to appeal from the order of the High Court as prayed. In the meantime the petitioner will be enlarged on bail to the satisfaction of the Ilaqa Magistrate. Leave granted.
