S.497--Bail--Accused aged about fifty-two years, held, could not be considered as aged or infirm person. --[Age]. Syed Abul Asim Jaffari for Petitioner. Azmat Dad for the State. Saif-ul-Haq Ziay for the Complainant. Date of hearing: 16th August, 1987. In brief the facts of this case are that Muhammad Sadiq complainant and his family members were sleeping in the courtyard of their house. Muhammad Sadiq on 12-9-1986 got up in the morning and found his daughter Mst. Farhat aged about 17/18 years missing. He started searching her. He was informed by Sultan and Rustam PWs that they had seen Mst. Farhat at about 6 A.M. on the canal bank alongwith Allah Bakhsh, Wahid Ali, Ghulam Hussain and Mst. Bashiran. His search was fruitless. He, therefore on that very day at about 5.30 P.M. got the present case registered. 2. Allah Bakhsh accused is absconding. Mst. Farhat abductee has so far not been recovered. Wahid Ali and Ghulam Hussain accused are in lock up. Mst. Bashiran accused was allowed bail being woman. Muhammad Sadiq and Ghulam Khawaja accused were admitted to bail by lower Court because they were not named in the F.I.R. Mst. Bashiran, Whaid Ali accused and Allah Bakhsh absconder are sons of Ghulam Hussain accused. This petition has been filed only on behalf of Ghulam Hussain. In support of this petition it is contended by learned counsel that Ghulam Hussain is an aged person and that he had no connection with the present occurrence. It is, therefore, argued that he be allowed bail. No other point was urged in support of this petition. Ghulam Hussain is stated to be aged about 52 years. He cannot; therefore, be considered as an aged or infirm person. He has been named in F.I.R. The prosecution case is supported by Sultan and Rustam P.Ws. who had seen Mst. Farhat in the company of the accused on the canal bank. Allah Bakhsh accused is still absconding. Mst. Farhat abductee has so far not been recovered. In view of these circumstances I am not inclined to allow bail to Ghulam Hussain. This petition is accordingly dismissed. M.Y.H./G-103/L Bail disallowed.
