Farooq Bedar, A . A .-G. for the State. MSt.Shamim Akhtar widow of Muhammad Aslam, resident of Gali No.l, House No.15. Faiz Park, Mughalpura, Lahore, has moved this application for transfer of case Shamim Akhtar widow v. Ghafoor Ahmad etc. pending in the Court of A.C./Magistrate First Class, Haroonabad to any other Court of competent jurisdiction at Lahore. The application is under section 3 of the Lahore High Court (Establishment of Benches) Rules, 1981 read with section 526 Cr.P.C. She has four minor children. She works for her livelihood as maid-servant. She is complainant in a criminal case registered against Ghafoor Ahmad and others vide FIR No.107/85, which is pending in the Court of A.C./Magistrate First Class, Haroonabad. Learned counsel for the petitioner submitted that the petitioner's mother Mst.Noor Begum was murdered by the relatives of the accused. She is a widow. She resides at Lahore. She looks after her four minor children. Counsel submitted that it is, not safe for her to go to Haroonabad. The A.A.-G. conceded that it is expedient and in the interest of justice if the case is tried at Lahore. I, therefore, transfer the case titled Shamim Akhtar v. Ghafoor Ahmad, etc. pending in the Court of A.C./Magistrate First Class, Haroonabad to Lahore and direct the District Magistrate, Lahore to entrust it to a Court of competent jurisdiction for trial in accordance with law.
