Accused was allowed bail in circumstances. Ch. Liaqat Ali Sandhu for Petitioner. A.H. Masood for the State. Date of hearing: 5th December, 1993. The petitioner is accused of offences under section 302/324/148/149/ 109, P.P.C. vide F.I.R. No.81/91, dated 9-8-1991, registered at Police Station Badiana, District Sialkot.

2. The learned counsel for the petitioner and the State were heard at length in respect of the contentions raised herein. Admittedly, the petitioner is not accused of having fired at the deceased and is only alleged to have fired alongwith his co-accused, Patras and Tahir Nadeem, specifically at the injured P.W. Bashir Ahmad, causing him simple injuries. In this respect reference was made to the certified copy of the medico-legal report, placed on the file. It was further confirmed on behalf of the State that the petitioner had associated himself with the investigation of the case on 16-10-1991, i.e. at the initial stage of the investigation, and had not been arrested by the police and had subsequently been declared as proclaimed offender in the instant and thereafter had been arrested on 24-7-1992. It was further confirmed that the petitioner is neither a previous convict nor a hardened criminal and that he is no longer required by the police.

3. Therefore, the petitioner is hereby allowed bail in the sum of Rs.30,000 with two sureties in the like amount to the satisfaction of A.C./Duty Magistrate, Sialkot. N.H.Q./A-515/L Bail allowed.
