‑‑‑Art. 199‑‑Benevolent Fund Scheme of Sind Bar Council‑‑Constitutional petition, admission of‑‑Petitioner who challenged through constitutional petition the authority of Sind Bar Council to collect benevolent fund, undertook to deposit amount of such benevolent fund with High Court‑‑On assurance of Sind Bar Council that no action would be taken against petitioner till hearing of petition, constitutional petition filed by petitioner was admitted by High Court for regular hearing. Judgment & Decree

MUHAMMAD ZAHOORUL HAQ, J.‑‑Mr. Gharib Nawaz has submitted that he has no intention of avoiding the payment of Benevolent Fund, but he wants to challenge the Authority of Sind Bar Council to collect the same. He undertakes to deposit the amount of Rs.2,746 with the Nazir of this Court today. In view of this, we would admit this petition to regular hearing. Notice of this petition is waived by all the learned counsel appearing for the other sides.

2. Miscellaneous 102/86 is no more relevant now in view of the fact that Mr. Gharib Nawaz is depositing the relevant amount in Court and Mr. Rashid has stated that they. are not going to take any action till the hearing of this petition. This application is, therefore, disposed of. H.B.T Petition admitted.
