Whole price of plot in dispute admittedly, had been paid by petitioner/allottee to Authority concerned, but despite such payment of price of plot, same had not so far been given to allottee--Representative of Authority, present in Court stated that he was ready to sort out case of petitioner for allotment of plot in question to him

High Court directed that case of petitioner for allotment of plot should be considered and decided by Authority on merits according to law at the earliest.

High Court directed that case of petitioner for allotment of plot should be considered and decided by Authority on merits according to law at the earliest. Muhammad Rashid Malik for Petitioner. Mahmoodul Hassan, Deputy Director (Legal) WAPDA for Respondents. Dates of hearing: 13th May, 1991. It has been conceded by the Secretary, WAPDA Employees Cooperative Housing Society Limited, Gujranwala that petitioner has paid a sum of Rs.25,400 as price for the transfer of his plot to him (Annexure `D'). Similarly attention of the Court has been drawn to another receipt, Annexure `C' showing that a sum of Rs.10,000 was deposited by the petitioner as remaining price of the plot in question. According to the learned counsel whole price of the plot in question has been paid by the petitioner and despite that the plot has not so far been given to ham. A representative of respondents Nos.1 and 2 (Mr. Mahmoodul Hassan, Deputy Director (L) WAPDA) has appeared. He is ready to sort out the case of the petitioner for allotment of the plot in question to him, with respondents Nos.1` and

2. In the circumstances case of the petitioner for allotment of the plot shall be considered and decided by respondents Nos.1 and 2 on its merits according to law as early as possible. The petitioner shall appear before the respondents on 1-6-1991. With these observations this petition stands disposed of. H.B.T./M-2997/L Order accordingly.
