‑‑‑‑Ss.106 & 139‑‑‑Constitution of Pakistan (1973), Art. 199‑‑‑‑ Constitutional petition‑‑ Enhancement of cattle Entry Fee‑‑ Constitutional petition had been filed to challenge enhancement of cattle Entry Fee of the animals in the "Cattle Peeri " within the territorial jurisdiction of Town Municipal Administration for 25 days in the month of Zil Haj‑‑‑Fee charged in year 2002 had been raised in year 2003, no additional facility was provided during said period‑‑‑Petition was disposed of by consent in the terms; that Authority would charge cattle Entry Fee at the rates (a) Cow/Buffalo, Rs.150 per animal; (b) Goat/Bakra Rs.50 per animal and; (c) Camel Rs. 250 per animal‑‑‑Fee was reduced accordingly.

Judgment & Decree

S. AHMED SARWANA, J.‑‑This ‑petition has been filed to challenge the enhancement of the Cattle Entry Fee of the animals in the Cattle Peeri within the territorial jurisdiction of town Municipal Administration Baldai, Town Karachi for 25 days in the month of Zil Haj from 15th Zilqad to 10th Zil Haj whereby the fee charged in 2002 has been raised in 2003 in respect of Cow/Buffalo from Rs.150 to Rs.250 per animal, Goat/Bakra from Rs.50 to Rs.150 per animal and Camel from Rs.250 to Rs.500 per animal. Respondents Nos.2 and 3 have filed their Parawise Comments but have not shown or specified any additional facility that would be provided at the Bakra Peeri during the said period which justifies the high increase. After hearing all the learned counsel, this petition is disposed of, by consent, in the following terms:‑‑ (1) Respondent No.4 shall charge Cattle Entry Fee for the above- referred period of 25 days at the following rate:‑‑‑ (a) Cow/Buffalo Rs.150 per animal (b) Goat/Bakra Rs.50 per animal (c) Camel Rs.250 per animal 2. As the Cattle Entry Fee has been reduced respondents Nos.2 and 3 are directed to give appropriate rebate to respondent No.4 as provided in paragraph 22 of the Agreement entered into between respondents Nos.3 and 4. Consequently, Miscellaneous Application No.39 of 2003 has become infructuous and is disposed of as such. H.B.T./T‑7/K Order accordingly.
