S. 13‑Eviction‑Evidence showing respondent not requiring dis puted premises for reconstruction but required amalgamation of two houses and reconstruction thereon and petition making out a clear case of personal need on reconstruction of house and not independent of same‑‑Appeal allowed. (b) West Pakistan Urban Rent Restriction Ordinance (VI of 1959)‑-- ‑‑ S. 14‑Res judicata‑Filing of second petition in eviction proceed ings on any fresh ground, held, would not be hit by principle of res judicata as contained under S. 14 of Ordinance.‑[Res judicata].
