‑‑‑Art. 199‑‑Civil Procedure Code (V of 1908), S.115‑‑Constitutional petition, competency of‑‑Constitutional petition against order of Senior Civil Judge asking petitioner to appear in person in pursuance of an application for contempt . of Court filed against him, held, was incompetent as submission made by petitioner in constitutional petition could easily be made by him before Single Judge of High Court under S.115, C.P.C.

Judgment & Decree

MUMAMMAD ZAHOORUL HAQ, J.‑‑The petitioner has felt aggrieved against the order issued by Senior Civil Judge asking the petitioner to appear in person in pursuance of an application for contempt of Court filed against him by respondent Wazir Hyder. Mr. Paryani has submitted that the notice should not have been issued without calling upon the petitioner to show cause against the same. He further contends that initially injunction issued against the petitioner in respect of the transfer of the respondent Wazir Hayat was not within the jurisdiction of the Civil Court. We are afraid that all the submissions' can easily be made by the petitioner before Single Judge of this Court under section 115 of C.P.C. where the petitioner can get adequate relief, therefore, this petition is incompetent and is hereby dismissed in limine. The Miscellaneous application is also dismissed. H . B . T . / C‑43 / K Petition dismissed.
