Judgment & Decree
Mst. Nur Begum, widow of Ahmed Shah, died on 5‑7‑
54. At the time of Ahmed Shah's death, his brother Jiwan Shah and sister, Mst. Sattan, were alive. Hussain Shah is the brother of Mst. Nur Begum and is still alive. Jiwan Shah has died leaving one son, Sardar Ali, and one daughter, Mst. Nur Begum. On Mst Nur Begum's death two points were disputed. One was whether Abbas Ali is the son of Mst. Sattan Bibi from Elahi Shah and whether Nur Begum widow of Ahmed Shah was a Shia or a Sunni The only point urged before me at the time of ,arguments was whether Abbas Ali is the son of Mst. Sattan, daughter of Syed Amir and widow of Elahi Shah. A mass of evidence, both oral and documentary was pro duced. Both the Collector and the Commissioner have come to tae concurrent finding that Abbas Ali is the son of Mst. Sattan, daughter of Amir. This finding cannot be called unreasonable in view of the fact that there is material to support it e.g., in the birth register Abbas Ali's date of birth is given as 25‑5‑1908, whereas Sattan daughter of Daim, is stated to have married as a virgin on 24‑11‑1915. Under these circumstances I de not find any illegality or material irregularity which has occasioned a failure of justice in the present case and so there is no ground for interference. The result is that the petition is dismissed. K. M. A. Petition dismissed.
