Judgment & Decree

KHAN and others Respondents Criminal Miscellaneous No. 140/M of 1989/BWP, decided on 12th March, 1989. ‑‑‑S. 176‑‑Penal Code (XLV of 1860), S.330‑‑Judicial inquiry‑‑Deceased belaboured by Police Official and others within view of seven witnesses appearing before Magistrate in judicial inquiry‑‑Post‑mortem report also showed injuries on person of deceased‑‑Police Official and others had tortured deceased after arresting him from Court premises and demanded bribe from him‑‑Incharge of police station was directed by High Court to register a case against the S.H.O. and others under S.330, P.P.C. in circumstances. Petitioner in person. Judicial inquiry report shows that about 7 witnesses had deposed before the learned Magistrate that Muhammad Yousaf S.H.O. and others had belaboured Sultan Mehmood alias Peeri, within their view, in Police Station Saddar, Sadiqabad, to satisfy their demand of illegal gratification. The post- mortem examination report also revealed some injuries on his person. No doubt, the doctor conducting post‑mortem examination had opined that Sultan Mehmood had died due to pnemonia and the medical board was of the view that he might have died due to heat stroke but the fact remains that after arresting him from the Court premises, Muhammad Yousaf S.H.O. and others had subjected Sultan Mehmood to torture and had also been demanding bribe from him. The S.H.O. Police Station Saddar, is, therefore, directed to register case; against Muhammad Yousaf and others under section 330, P.P.C. on the basis of 4, complaint marked of Mst. Ghulam Zohran. Copy of the complaint alongwith the order of this Court be immediately sent to him for compliance. He will send' copy of the F.I.R. within 3 days to this Court. Order accordingly.
