Counsel for authorities had stated that no action in respect of the property of the petitioner had been taken, and in any event even if some part of his property was acquired for the purpose of the road, same could only be acquired upon payment of compensation in accordance with requirement of Land Acquisition Act 1894
Counsel for petitioner being satisfied with undertaking of counsel for authorities, petition was dismissed having not been pressed subject to said undertaking.
Judgment & Decree
Mr. Manzoor Ahmed states that no action in respect of the property of the petitioner has been taken and in any event even some part of his property is required for the purpose of the road and it would only be acquired upon payment of compensation in accordance with the requirement of the Land Acquisition Act. The above undertaking is placed on record and Mr. Samdani satisfied with the same. The petition is dismissed as not pressed, subject to the above undertaking. H.B.T./S-116/K Order accordingly.
