Judgment & Decree
The respondent Trade Union was registered in the name of Association of Officers of Population Planning Council, T. R. E. C., Lahore by the Registrar of Trade Union, Lahore Region, Lahore of 8th May 1974 vide Certi ficate No. 138/74. The Registrar of Trade Unions Lahore Region, Lahore has filed the under-consideration application under section 10(1) of the Industrial Relations Ordinance, 1969, seeking cancellation of the Registration of the respondent-Union. He has maintained that Industrial Relations Ordinance, 1969 did not apply to the employees of Population Planning Department ands therefore the respondent-Union could not be legally registered. 2, The respondent-Union has resisted the application and has pleaded that if the respondent-Union was not legally registrable why the Registrar had registered it in V 74.
3. Copy of the constitution of the respon4ent's Association has been filed by the Registrar alongwith application. From its contents it appears that this is an Association of Officers employed in the Population Planning Department. Such officers obviously are public servants and in view of their status and the nature of duties being performed by them, they are certainly persons employed in the administration of the state within the meaning of section l (3) of the Industrial Relations Ordinance, 1969. In case of such officers the Industrial Relations Ordinance, 1969, is not applicable A and therefore their Association could not be legally registered under the provisions of the Industrial Relations Ordinance as a Trade Union.
4. In the light of what has been said above I accept the under, consideration application filed by the Registrar and direct that the registration of the respondent's Association be cancelled.
