Accused entitled to grant of bail in circumstances-Penal Code (XLY of J860), Ss. 302, 346, 354, 462, 452 & 148/149: Miss Gulshan Ara Alam for Petitioners. Ch. Muhammad Akram for the State. A case under sections 302, 3541 366, 452, 462 read with sections 149 and 148, P. P. C. has been registered against the petitioners and four others, one of whom is an absconder, on 2& 11-1971, at P. S. Chichawatni, District Sahiwal. So far the matter has not gone to Court. The investigating officer is present and informs me that the investigation is complete but the challan is being checked by the Prosecution Branch. The prosecution version is, that Mst. Ulfat Bibi wife of Abdul Ghani had gone to live with Muhammad Bakhsh. He was beaten by Abdul Ghani and a case was registered against hire. Hanif son of the complainant had no liking for Mst. Ulfat. He did not like that his father should keep her. Thereupon, along with Muhammad Irshad, Mahmood, Sardar and he petitioner, naively, Pervaiz Ahmad and Chiragh Din he went to tire complainant's house and tied him. The accused, thereafter, managed to take away Mst. Ulfat. Subsequent thereto they attacked Ghulam Rasool, Muhammad Sharif and Niaz Muhammad who were friends of the complainant hey were injured. Ghulam Rasool died. The report was lodged with the Police by Abdul Ghana complainant. It is maintained that Muhammad Sharif and Muhammad Shaban referred to above appeared before a Magistrate at Sahiwal, on 15-3-1972, and made statements exonerating the petitioners. Certified copies of their statements have been placed on the record. I have perused them. Both these witnesses have stated that they did not see Pervaiz Ahmad and Chiragh Din, petitioner, at the time of the occurrence. In view of the said state of affairs it appears to me, that the petitioner are entitled to the grant of bail. They shall be released on bail, provided, they execute bail bond in the sum of Rs. 25,000 (Twenty five thousand) each with one surety each in the like amount to the satisfaction of the Assistant Commissioner, Sahiwal.
