Samiullah Khan and Muhammad Akram for Petitioner. Nadeem‑ud-din Malik for Respondent. Date of hearing: 4th March, 1989. Learned counsel for the parties state that the parties have not been able to reach any compromise.
2. This is an application by Mst. Irshad Begum under section 25‑A of the Family Courts Act for the transfer of suit for restitution of conjugal rights brought against her by respondent from the Court of Mr. Muhammad Aslam Bhatti, Judge family Court Wazirabad to the court of Rana Ghulam Sarwar Kadri, Civil Judge/Judge Family Court, Lahore where her three suits; one for dower, second for maintenance and the third for articles of dowery, are pending.
3. The transfer is sought on the grounds that the marriage of the parties' was performed at Lahore that the petitioner is a pardah nahseen lady with a suckling child about nine months old and it would be inconvenient to her to contest the suit of the respondent at Wazirabad.
4. The application is opposed on the ground that the suit of respondent is prior in time.
5. I have heard learned counsel for the parties. In view of the reasons given by the petitioner, this application is allowed. The suit of the respondent for restitution of conjugal rights is withdrawn from the Court of Mr. Muhammad, Adam Bhatti, Judge Family Court, Wazirabad and transferred to the Court of Rana Ghulam Sarwar Kadri, Civil Judge/Judge Family Court, Lahore. Both the Courts shall be informed accordingly. H.B.T./1‑131/L
