I want to file for Khula from my husband due to mental abuse and non-maintenance. How long does the process take in family courts, and do I have to return my Haq Mehr?

To obtain Khula, you must file a Suit for Dissolution of Marriage in the Family Court under the Family Courts Act 1964. The court will issue notices and attempt reconciliation. If reconciliation fails, the court will grant Khula. Generally, you must waive your unpaid Haq Mehr (dower) or return the dower received at the time of marriage.
