Date of hearing : 22nd October 1968. HAMOODUR RAHMAN, J.‑This petition seeks to call in question the correctness of the Full Bench decision in the case Sher Muhammad v. Additional Commissioner (P L D 1968 Lah. 234). Leave has already been granted in the Civil Petitions Nos. 189 and 380 of 1968, to consider the same point, namely, whether a female who held a limited estate in India and submitted a claim under the Punjab Refugees (Registration of Land Claims) Act, 1949, did so as an owner within the purview of paragraph 2, Part r, Chapter. If of the Rehabilitation Settlement Scheme in her right and not on behalf of the reversioners; and whether on the death of such a refugee limited owner it is her personal heirs who succeeded to her and not the heirs of the last male‑owner. Leave is, accordingly, granted in this case also to consider the same point. The appeal arising out of this petition will come up along with the appeals arising out of Petitions Nos. 189 and 380 of 1958. Security‑Rs. 1.000 and during the pendency of the appeal in this Court the stay order granted on the‑ 26th August 1968, will continue on the‑ same terms. Leave granted.
