Quashing of F.I.R.

Petitioner in his statement recorded by Investigating Officer had denied all the allegations levelled in F.I.R.

Petitioner had stated that she being sui juris had entered into marriage with co-accused according to her own free will and consent

Complainant though served, had not appeared despite repeated calls

F.I.R. lodged by the complainant was quashed because further proceedings on the basis of F.I.R. would be clear abuse of process of court and law.

Judgment & Decree

KHAWAJA MUHAMMAD SHARIF, C.J.

The complainant was served but he has not appeared. Though the case has been called repeatedly. Investigating Officer present in person submits that the petitioners have not joined the investigation. I direct him to record the statement of Mst. Farzana Anwar, alleged abductee, in the room of my Private Secretary and then to appear before this Court after about fifteen minutes. (Sd.) Khawaja Muhammad Sharif Chief Justice Presence as before. Investigating Officer has recorded the statement of Mst. Farzana Anwar in which she has denied all the allegation levelled in the F.I.R. She has stated that she is being suit juris has entered into marriage with Babar Hussain according to her own free will and consent. Complainant though served has not appeared despite repeated calls. In this .view of the matter, this petition is accepted. F.I.R. lodged by the complainant is hereby quashed because further proceedings on the basis of instant F.I.R. would be clear abuse of process of Court and law. H.B.T./F-19/L F.I.R quashed.
