S.25--Custody of minor--Arrangement of meetings between father and minor child agreed to between parties being fair, Supreme Court converted petition into appeal and disposed of same in terms of agreement between the parties.

Judgment & Decree

MUHAMMAD AFZAL ZULLAH, J.‑‑This petition relates to a dispute between the parties over the custody of a minor boy After some arguments, the learned counsel for the petitioner gave up the point with regard to the question as to who ‑at the present stage is entitled to the custody of the boy. He, however, contended that the arrangement of meetings between the petitioner and the boy made so for, may require re‑examination in the interest of the welfare of the minor.

2. On our asking both the learned counsel and their clients entered into negotiations on the aforestated dispute and as a result whereof an amicable agreement has been reached, which is reproduced below: ‑‑ "

1. That parties to the titled C.P.S.L.A. have entered into a compromise on the following terms and conditions: ‑‑ (a) That titled C.P.S.L.A. shall be withdrawn. (b) That the respondent or her representative shall take the minor Muhammad Tahir to the house of Haji Muhammad Sharif real brother of Muhammad Latif father of respondent at Batapur on each alternate Friday in each month where petitioner and his other family members may meet the said minor for three hours i.e. 10 a.m. to 1‑00 p. m. (c) Parties shall bear their own costs.

3. The arrangement is fair, we convert this petition into appeal and dispose of the same in terms of the afore‑recorded agreement. There shall be no order as to costs. M.B. A. /M‑461/S?????????????????????????????????????????????????????????????????????????????? Order accordingly.
