S, 21(1)--Appal--Identical questions of fact and law involved in other appeals already decided and remanded by High Court by consent of parties to Rent Controller--Properties involved owned by same landlord--High Court remanded present appeal as wll iterm:i of previous judgment. Hafiz Abdul Baqi for Appellant. Fazalbhoy for Respondent. Date of hearing: 24th March, 1985. This is an appeal against an order, dated 16-12-1981 passed by the XIIth Senior Civil Judge and Rent Controller, Karachi in Rent Case No. 2979 of 1974 dismissing the appellant's application which was filed on the ground of default. It seems that the appellant had filed 4 rent cases against 4 tenants on the ground of default. The learned Rent Controller had dismissed the three Rent Applications earlier, namely, Rent Application Nos. 2366 of 1974, 2978 of 19.74 and 4149 of 1965. Against the above dismissal order the present appellant had filed First Rent Appeals Nos. 173, 174 and 175 of 1981 which were disposed of by me by a common judgment, dated 2nd September, 1984 and the cases were remanded to the learned Rent Controller in terms of the judgment. The present appeal has been filed by the appellant against the above order of dismissal of above Rent Application.
2. Since identical questions of fact and law are involved in the present appeal, and the above remanded cases by consent I would remand this case as well to the learned Rent Controller in terms of my above judgment, dated 2nd September, 1984. The appeal stands disposed A of in the above terms with no order as to costs. This case will also b tried by the learned Xth Rent Controller, Karachi whom the aforesaid three connected cases have been remanded. H.B.T. Order accordingly.
