S. 497-Penal Code (XLV of 1860), S. 161-Prevention of Corruption Act (1I of 1947), S. 5 (2)-Bail-Offences of which accused charged with not punishable for life or even with imprison ment up to ten years-Accused, held, entitled to grant of bail-Bail allowed. Muhammad Bashir Khan for Appellant. This is an application for bail. A case is registered against the petitioner under section 161, P. P. C. read with section 5 (2) of the Pre vention of Corruption Act at Police Station Anti-Corruption, Multan, dated 23rd April, 1983. The offence under section 161, P. P. C. is punish able with imprisonment upto three years and the offence under section 5(2) of the Prevention of Corruption Act is punishable with imprisonment upto seven years. In other words, the offences of which the petitioner is charged are not punishable with death or imprisonment for life or even with imprisonment upto ten years. In that view of the matter, the petitioner is entitled to the grant of bail. 2. Admit. Notice. 3. The petitioner is allowed interim bail subject to his furnishing security in the sum of Rs. 10,000 (Rupees ten thousand only) with one surety in the like amount to the satisfaction of Assistant Commissioner, Multan. 4. A copy of this order should be given Dasti to the petitioner' on payment of usual charges. 5. The Investigating Officer should appear alongwith the record on the date of hearing. M. Y. H. Bail granted.
