Judgment & Decree
Muhammad Humayun for Applicant. This is a revision application under section 38(3‑a) of the Industrial Relations Ordinance, 1969, against the order dated 8‑3‑1999 passed by the Presiding Officer, Sindh Labour Court No.2. Karachi.
2. Heard Mr. Humayun, for the applicant. It is submitted by him that on 3‑3‑1999, nineteen complaints were filed by Assistant Director Labour & Inspector of Factories against two officers of the management i.e. The Managing Director and the Manager under the Factories Act for violation of section 2(g) of Standing Orders Ordinance. 1968, whereupon the learned Labour Court has passed the following order:‑‑‑ "Issue process"
3. It is now pleaded before me by the learned counsel that only the Manager under Factories Act can be prosecuted and not the Managing Director or any other person. The impugned order contains two words only "issue process". Let the counsel take up this plea before the learned Presiding Officer on the date fixed in the case i.e. tomorrow.
4. The revision application is pre‑mature to interfere at this stage without giving opportunity to the learned Presiding Officer to express his mind on the point at issue as raised before me. It will be most unfair on my part to interfere in the matter.
5. For the above reason, the revision application is dismissed in limine. H.B.T./338/K(L.Trib) Revision dismissed
