Retirement

Employee whose retirement had been taken into consideration on reaching age of superannuation and letter had been sent to him by employer that he would retire on specified date, had produced copy of Entry in Birth Register of Municipal Corporation which showed date of birth of employee different from date mentioned by him in his application for employment

All records after his employment with employer bore date of birth mentioned in application for employment and nothing was on record to show that employer was informed about revelation of different date of birth or any attempt had been made by employee to get record corrected accordingly despite copy of entry of record of Municipal Corporation had been with employee since long time

Employee having slept over the matter for a long time, could not allege that he was being victimized because he was an office bearer of Union. Gohar Iqbal for Applicant.

Judgment & Decree

Date of hearing: 1st December, 1991. The applicant is working with Messrs Caltex Oil Pakistan Limited in their Head Office at Karachi. The company on 3-9-1953 had employed him. In his application for employment the date of his birth was written as 22-10-1931. It appears that all the records thereafter during this time bear this date.

2. It is stated by Mr. Gohar Iqbal learned counsel for the applicant that the date of birth later on was found to be 21-6-1934 as evidenced by the copy of the Entry in the Birth Register of Karachi Municipal Corporation.

3. There is nothing to show that the management was informed about this revaluation or any attempt has been made to get the record corrected.

4. The question of retirement had been taken into consideration as he was reaching the age of superannuation and the management had sent a letter to him that he would stand retired on 31-10-1991.

5. On his own showing the copy of the Entry of the record of the Municipal Corporation had been with him since 1959. Even then he had slept about the matter. The allegation that he is being victimised because he is an office-bearer of the union is wide of the mark.

6. The application under Order 39, Rules 1 and 2, C.P.C. has been properly considered by the learned Presiding Officer and I do not find any justification to interfere with the order. I would, therefore, dismiss the application in limine. H.B.T./2000/Lb. S Application dismissed.
