Judgment & Decree
Khizar Tamimi for Respondent. The dispute in this case relates to the entry regarding the possession of nearly 14 fields which were supposed to be leased with the petitioner during the harvest of Kharif 1954. The Patwari recorded the respondent as the person in possession of that number of fields. The petitioner put in a petition before the Assistant Collector I Grade requesting that he should be shown as the person in possession. This petition was, however, filed after the Girdawari had been completed. The Assistant Collector decided on merits that there was no case for changing the entry in the Khasra Girdawari. There was an appeal to the Collector who decided that on merits the petitioner was the person entitled to be shown in possession. He, therefore, required that the Khasra Girdawari entry should be corrected. The other party went up in appeal to the Commissioner who decided that the Khasra Girdawari entry cannot be changed. I do not know why the parties are carrying on this dispute between themselves. The decision of the highest authority on merits so far is that the real person in possession was the petitioner. An entry to that effect should be made in red ink in the Khasra Girdawari without removing the previous entry. This order can be passed by me without hearing the other party. The petition for revision will be considered to have been accepted to the extent indicated. A. H. Petition accepted.
