Constitutional petition

Non-entering of mutation in record of rights

Grievance of petitioner was that he had acquired interest in certain immovable properties through registered instruments, but authorities were not effecting mutation of said properties in the record of rights

Authorities had conceded that the powers and functions which were originally exercised by Revenue Officers stood devolved upon the City District Government in terms of S.14 read with Item XXVI of the First Schedule to the Sindh Local Government Ordinance, 2001

Held, that duty to maintain record of rights and to cause .mutation therein, vested in City District Government which was directed to effect appropriate mutation under the provisions of West Pakistan Lund Revenue Act, 1967, if the provisions of said Act so required, within specified period.

Judgment & Decree

SABIHUDDIN AHMED, J.

The facts, as may be relevant for the disposal of this petition, are not seriously in, dispute. The petitioner contends that he has acquired interest in certain immovable properties through registered instruments but the respondents are not causing mutation in the record of rights. Mr. Manzoor Ahmed candidly concedes that the powers anti functions which were originally exercisable by Revenue Officers stand devolved upon the respondent No.1 in terms of section 14 read with Item XXVI of the First Schedule to Sindh Local Government Ordinance, 2001. It would accordingly follow that the duty to maintain record of rights and cause mutation therein now vests in the respondent No.1.

2. In view of the above, the respondent No.1 are directed to effect " appropriate mutation under the provisions of the Sindh Land Revenue Act, 1967, if the provisions of the Act so required, within two months from today. In case mutation could not be effected for any valid reason, the respondent No. 1 would apprise the petitioner in writing the grounds for such refusal. H.B.T./F-14/K Order accordingly.
